TERMS AND CONDITIONS

A completed “Vacation Rental Agreement” is required within 24-hours to hold your reservation. The Rental Deposit is due upon receipt. Review and acceptance of the Southern CaliforniaRentals Terms & Conditions which is made part of this rental agreement is required before a confirmation will be issued. 

RATES:
Rates are quoted on a per night, per week or per month basis as noted. Unless specified, check-in time is after 4:00 p.m., and checkout by 11:00 a.m. on the day of departure. Most rates quoted are for a specified number of people (4 for 2-bedroom, 6 for 3-bedroom), additional guests are subject to a per person, per day charge. Charges vary and are subject to change without notice. All properties represented by Southern California Rentals come fully equipped with television(s), linens, dishes and utensils and an initial supply of soap and paper goods. Other amenities vary per property.

ADDITIONAL CHARGES (NOT included in rate):
Rates do NOT include daily maid service (unless noted), gratuities, car rental, food, liquor, laundry, personal items, excessive cleaning upon departure (i.e. upholstery or carpet cleaning, etc.). For long term stays of 28 days or more, there is a utility cap of {reservations_unit.utility_cap_for_long_term}/month. If the utilities exceed this cap, you are responsible for any overages from either the security deposit or payment information on file.  If guest has a party, guest authorizes the forfeiting of the entire security deposit at a minimum, plus additional expenses if damages are caused.  A party is defined as any combination of the following; ANY loud noise and/or excessive drinking that is disruptive to neighboring houses and/or guests outnumbering the maximum amount permitted as defined above. A party will result in an immediate eviction from the property with no refund given under any circumstance. Any exceptions to this policy must be approved by Southern California Rentals in writing prior to the arrival date.   Guest Authorizes a $50 replacement charge or actual cost of replacing, if more, for any Tablets, keys, remotes including garage door, light, AC, Heater, TV, Video Game, Apple TV or other remotes or faubs not left in the home at the time of check-out. 

RESERVATIONS AND PAYMENTS:
Payment of the applicable 50% Rental Deposit amount together with a completed Guest Reservation Application must be received and approved by Southern California Rentals before a confirmation will be issued.  No grace period will apply. Final payment, consisting of the remaining balance, must be received by Southern California Rentals at least thirty (30) days prior to guest arrival (or immediately if booked less than thirty (30) days in advance of guest arrival). Failure to make final payments on a timely basis will make reservation subject to automatic cancellation.

CONDITION OF RENTAL:
It is the Guest’s responsibility to report any pre-existing damage to Southern California Rentals within 2 days of arrival.  The property shall be left in the same condition upon departure as at check-in. Normal wear and tear excepted. Owner or its agents may enter the property at reasonable times with notice given to guest to make necessary repairs or provide requested maid service.  Guest may only cook in areas specifically designated for cooking.  Guest must immediately notify Owner or agent of fire, flood, any water leak or other damage to property. Guest shall be liable for all acts of the family, invitees, employees, or other persons invited onto the property.  Guest may not sublet or assign this rental agreement. Guest shall be responsible to return all keys, faubs, gate or garage door openers to where they were found at check in, upon departure.  Guest shall abide by the House Rules of the Owner, Property Manager, Condominium Association and/or the Booking Agent as provided to Guest.  Guests shall not bring any unauthorized pets onto the property, pets must be pre-screened for breed size and behavior and approved in writing, and pet rent paid at the time of booking. 
Guest will not smoke on the property. Guest will rinse feet of sand prior to entering the unit. No parties shall be allowed without prior consent. Additional charges may apply. No catering or outside music permitted without prior consent, additional charges may apply. Guest shall not permit any use of pool or Jacuzzi by unsupervised children or other guests, and shall keep gates to pool area and yard closed and property locked.  Guest and other invitees shall use the pool and jacuzzi and all features of the home at their own risk. Guest understands that there are certain inherent and unforeseeable risks to person and property when renting a home and assumes all risks, including the possibility of drowning, slips falls, kitchen accidents etc. Guest acknowledges that the owner would not rent the property unless the Guest accepted this condition.

MOLD AND VENTILATION NOTIFICATION AND AGREEMENT: 

Except as may be noted at the time of Tenant’s move in inspection, Tenant agrees that the Premises is being delivered free of known damp or wet building materials (“mold”) or
mildew contamination. Tenant acknowledges and agrees that (i) mold can grow if the Premises is not properly maintained; (ii) moisture may
accumulate inside the Premises if it is not regularly aired out, especially in coastal communities; (iii) if moisture is allowed to
accumulate, it can lead to the growth of mold, and (iv) mold may grow even in a small amount of moisture. Tenant further
acknowledges and agrees that Tenant has a responsibility to maintain the Premises in order to inhibit mold growth and that
Tenant’s agreement to do so is part of Tenant’s material consideration in Landlord’s agreement to rent the Premises to
Tenant. Accordingly, Tenant agrees to:
1.  Maintain the Premises free of dirt, debris and moisture that can harbor mold;
2.  Clean any mildew or mold that appears with an appropriate cleaner designed to kill mold;
3.  Clean and dry any visible moisture on windows, walls and other surfaces, including personal property as quickly as possible;
4.  Use reasonable care to close all windows and other openings in the Premises to prevent water from entering the Premises;
5.  Use exhaust fans, if any, in the bathroom(s) and kitchen while using those facilities and notify Landlord of any inoperative exhaust fans;
6.  Immediately notify Landlord of any water intrusion, including but not limited to, roof or plumbing leaks, drips or “sweating pipes”;
7.  Immediately notify Landlord of overflows from bathroom, kitchen or laundry facilities;
8.  Immediately notify Landlord of any significant mold growth on surfaces in the Premises;
9.  Allow Landlord, with appropriate notice, to enter the Premises to make inspections regarding mold and ventilation; and
10.  Release, indemnify, hold harmless and forever discharge Landlord and Landlord’s employees, agents, successors and assigns from any and all claims, liabilities or causes of action of any kind  that Tenant, members of Tenant’s household or Tenant’s guests or invitees may have at any time against Landlord or Landlord’s agents resulting from the presence of mold due to Tenant’s failure to comply with this Lease/Rental Mold and Ventilation Addendum.

Vacation Rental Damage Protection:As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $5,000.00.  Any damages that exceed $5,000.00 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $5,000.00. The Vacation Rental Damage can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. d/b/a Generali Global Assistance & Insurance Services to pay directly Southern California Rentals any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Southern California Rentals directly if you do not wish to participate in this assignment.SECURITY DEPOSIT:
Security Deposit Protection Program Guests are required to make a Security Deposit to protect against any damages to and/or loss of items from the Property and to assure payment of items charged to the Guest Account. The deposit will be held in Southern California Rentals Client Trust Account or the booking agents account and will be returned, minus deductions, not later than 21 calendar days after the termination of the agreement. We must give you a written statement at that time explaining any deductions. Deductions can be made for the following reasons: to repair or replace anything that is damaged or missing; to pay any and all amounts due; to replace all keys; additional cleaning expense or to clean excessive dirt (i.e. stained carpets, furniture, walls, appliances, etc.) and put the unit, and the things in it, in the condition when you moved in. If your deposit is not enough to cover all the damages and costs, you must pay the extra amount, and you authorize us to charge the credit card provided. A discounted security deposit is advertised with each property, which is the amount you pay if you choose to purchase the Security Deposit Protection Plan as outlined above.  If guest chooses not to purchase the protection plan, guest authorizes the market deposit of 2x one month’s rent for a furnished home.  


LIMITATION OF LIABILITY:
Under no circumstances shall Southern California Rentals be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or land accommodations by Southern California Rentals or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted; Southern California Rentals, at all times will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. Southern California Rentals will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. Some activities in which guests engage are especially dangerous and include scuba diving, snorkeling, deep-sea fishing, boating, golfing, swimming, boogie boarding, surfing, hiking, biking and mountain climbing. This list is not all-inclusive, but indicates some of the hazards of vacationing in San Diego. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, balconies with spaces between rails (dangerous for little children), precipitous drop-offs on ocean floor, unfenced pools, faulty electrical or plumbing systems, gas BBQ grills, clean/clear sliding glass doors, and dangerous stairs or pathways, Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this home, you acknowledge that in all events and circumstances, Southern California Rentals, its officers and employees shall not be liable. Southern California Rentals reserves the right to cancel or rescind without refund any rental agreement if it is found that the Guests are conducting unlawful activities, not abiding by the House Rules or Home Owners Association House Rules, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the rental agreement.representations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the rental agreement.

NOTICE OF ABSENCE:
You must tell us in advance if you will be absent from the property for 5 days or more. If you do not give us this notice, you will have to pay for any damage that may result from your absence.

HOLDOVER, ABANDONED POSSESSIONS AND SERVICE OF NOTICES:
If guest or any occupant, authorized or unauthorized, stays in the unit, without written permission, after the Rental Agreement has ended, the guest will be a holdover tenant and may be liable for twice the daily advertised rent, under the Rental Agreement on a prorated daily basis for each day you are a holdover tenant.  Holding over is defined as not checking out on time on the day of check out, regardless of amount of time guest is late to check-out.  Guest authorizes holdover charges to the card on file or their security deposit.  Charges begin 3 hours after check out and continue at 12:00 AM daily if guest continues to hold over.  If guest leaves any personal property, which we determine to be of value, we must contact you by emailing a notice. After 20 days, if you have not picked up items, we may advertise the items for sale or donate them to a charitable organization. If we have to give any notice to you, we can serve it to any occupant. By serving one of you, we have given notice to all of you. If we cannot deliver a notice to you, we may post the notice in a conspicuous place in or on the unit. If Guest requests left items to be mailed to them, the guest must provide the forwarding address, Guest approves the charges of postage and handling compensation to be paid out of their deposit or charged to the credit card on file to Southern California Rentals for the time and supplies it takes to prepare and mail the items. 

INSURANCE:
You understand that our insurance does not cover your belongings or damage that you cause. You agree that we are not responsible for any loss or damage during the term of the rental agreement. You agree to carry insurance covering all of your personal property located in the unit or bear full responsibility for its damage including damage from fire, water, theft, or any cause.

CHANGES TO A BOOKING:
An additional $50.00 administrative fee will be charged by Southern CaliforniaRentals for any change to a booking after a Confirmation has been issued. Acceptance of any change is subject to approval by Southern CaliforniaRentals.

POOL RULES:
ALL GUESTS MUST READ AND AGREE TO POOL WAIVER, BELOW: 
*NOTE: Pool heating is available at a {reservations.tax_pool heating fee} per day cost. Please inquire about pool heating and number of days so we can advise of the charges accordingly

USE OF SWIMMING POOL WAIVER OF LIABILITY
This Agreement waives any and all liability of “Southern CaliforniaRentals” and {owner.payment_check_payable_to} HEREINAFTER “Managers” and “Home Owners” respectively, for any use of the swimming pool on the property located at {reservations.location_address} (The Property). A non-parent cannot legally sign this waiver for other people’s children. It must be signed by a parent/legal guardian of children under 18 years old.

PLEASE READ CAREFULLY
1. I, the tenant reserving this property wish for myself, my guests and my child(ren) (if applicable) to utilize the swimming pool offered at the house located at {reservations.location_address} (The Property).
2. I hereby agree that the use of the swimming pool is voluntary and at my own risk.
3. As a condition of my/our use of such swimming pool/spa, I on behalf of myself, our heirs and assigns and my child(ren) (if applicable) expressly agree to forever discharge, waive and release The Managers and Home Owners, from any and all claims, demands, injuries, damages, actions, or courses of action, for all acts of active or passive negligence on the part of The Managers or Home Owners on account of bodily injury, mental injury, death and/or property damage from, any mishap, accident, loss, damage or injury suffered by my child(ren), or myself or others resulting from, connected with or caused by the use of The Property, swimming pool including, but not limited to any injury resulting from mechanical defects or failure of any equipment or devices used in such services, swimming pool or facilities.
4. I declare and affirm that I, my child(ren) or other guests I invite to the property (if applicable, but unbooked guests not allowed without prior written permission) are in good medical and physical condition and that the use of The Property services, swimming pool do not pose any danger to me, my guests or my child(ren)ʼs (if applicable) health.
5. Pool Rules:1. All users must shower before entering the pool.
2. Guests under the age of 18 years of age must be accompanied by parent or guardian at all times.
3. Guests under the age of 18 must have this liability waiver completed by their parent.
4. Participation is at your own risk.
5. No alcohol is allowed in the pool or on the pool deck.
6. No glass or metal containers are allowed in the pool, spa or the surrounding areas consisting of the concrete deck and planter area. Non-alcoholic beverages in plastic containers are allowed.
7. All accidents must be immediately reported to the Property Manager.
8. Participants are encouraged to report any maintenance/repair needs to the Property Manager.
9. Diving is not permitted, as serious injury, paralysis or even death could occur.
10. People with open wounds or infectious diseases are not permitted in the pool or spa.
11. No persons with active diarrhea (within the last 14 days) or vomiting allowed in pool or jacuzzi. 
12. No running, pushing and horseplay on deck areas.
13. No one under 18 allowed in Jacuzzi.
14. Please no food or drinks in the pool or Hot Tub.
15. If applicable, always keep pool gate closed and back garage door closed and locked for pool safety.
16. No lifeguard on duty.
17. Guests are responsible for always supervising all members of their group, especially children, at all times. 
I understand and agree that my use of The Property swimming pool may be immediately terminated if my and/or my child(ren)ʼs behavior is not in accordance with the above.

CANCELLATION AND REFUNDS:
Cancellation of booking at any time after Confirmation has been issued may result in forfeiture of deposit(s). Cancellation within the 60-day period prior to check-in may result in forfeiture of the entire rental amount. Refund of monies paid for rental and services will be made under the following circumstances: (1) If, on the day that the rental is scheduled to begin, the property is unfit for habitation and no equivalent substitute can be obtained, or the property is not reachable by the usual means of transportation, or access to the property by visitors has been prohibited by authorities; or (2) The Villa is re-booked for the same time period and at the same rate of initial booking. If a portion of the rental time is re-booked, a pro-rata refund will be made. All refunds, whether in whole or pro-rata, will be subject to the deduction equal to 15% of deposit(s) paid. To protect against cancellations caused by certain unforeseen events, such as illness, death, natural disasters, etc.,

Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. The plan also includes other valuable coverages such as Medical and Dental, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance. CATASTROPHIC EVENTS & EMERGENCY EVACUATIONS: 

If a catastrophe (hurricane, tornado, earthquake, flood, etc.), disaster or any situation simply beyond our control impairs the vacation rental, Southern California Rentals is not responsible for finding alternate lodging for the renter or for the renter’s financial losses related to transportation or alternate lodging or inability to complete their stay.  There will be NO REFUNDS OR CREDITS FOR EMERGENCY EVACUATIONS. Whether you own property, run a business, or rent a home, the threat of a hurricane, flood, tsunami, and other disasters is always present, and we all assume this risk. Therefore, we strongly suggest you consider Travel Protection Insurance to help protect your vacation investment. There will be no refunds of any kind for evacuations or inability to travel to the home for your trip.  Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for the loss of prepaid, nonrefundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. We strongly recommend you purchase this valuable protection. ACKNOWLEDGEMENT:
I/we, the undersigned, hereby apply for the above listed accommodation and warrant that I/we have read, understand and agree to the terms and conditions of this application, and I/we agree to abide by homeowners/agents/association restrictions on use of said property. I/we further understand and represent that I/we are executing this application on behalf of all parties named on the guest list.
